CFTC’s Quintenz: dealer threshold could exclude cleared swaps

Commissioner suggests risks should be better considered in de minimis reappraisal

The CFTC is considering excluding cleared swaps from the activity threshold for swap dealers

Brian Quintenz of the Commodity Futures Trading Commission (CFTC) says cleared swaps should not count towards the activity threshold that requires firms to register as swap dealers, coming into scope of strict compliance rules.

“We need to think about removing cleared swaps from the threshold since they don’t necessarily pose dealer counterparty risk,” the commissioner tells Risk.net. “I’d argue for exclusion.”

Quintenz says it’s just one of a variety of factors the regulator might consider
